Civil Process

Function

The civil process division handles all seizures of foreclosure property ordered by the courts by virtue of writs of seizure and sale, garnishments, attachments, fieri facias, sequestration, and possession.

Staff

Our support personnel for the civil process division work closely with our process servers, who are part of our judicial process division. These two divisions work seamlessly together handling both civil and criminal topics assigned to their divisions.

Auctions

Movable and immovable property is seized and, after time delays and advertisements are published in the local legal journal, later sold at a public auction. These auctions are held at the front door of the Parish Courthouse on Wednesdays at 10:00 am and items are sold to the highest bidder. Payment is due by 2:00 pm the day of the sale in the form of a cashier's check.

Garnishment of Wages & Seizure

Garnishments of wages are processed through the Civil Division's seizure branch. Service of notice of seizure is made on the employer and payments are sent to the Sheriff's Office for processing.

Subpoenas

The civil process division also handles civil and criminal subpoenas. Evictions are also done on property that has been seized and sold if the occupant fails to vacate as directed. This process is handled with the help of the Sheriff's Office judicial process division, who serve the subpoenas.
